Proof of Damages in Arbitration - State of Rajasthan Case

Sections 73 and 74 of the Indian Contract Act, 1872, provide for compensation for loss or damage caused by breach of contract, i.e., payment of damages by the party who has caused the breach to the party who has suffered a loss by reason of such breach.

A claim for damages cannot be granted simply for the asking, such claim must be backed by evidence of actual loss or injury. A mere breach cannot support a claim for damages.
