Setting Aside of Awards due to Fraud and Collusion - Rashmi Metaliks Case

The Arbitration and Conciliation Act, 1996 (‘the Act’) provides for the procedural scope of arbitration. After an award is passed by the arbitrator, either party being aggrieved by the award, may make an application for setting aside of the award. When the award is not challenged within the time provided under Section 34 of the Act, either party may apply for enforcement of the award under Section 36 of the Act.
