On 12.06.2023, the High Court of Delhi (HC) dismissed an application filed by the MMTC Limited challenging an arbitral award under section 34 of the Arbitration and Conciliation Act, 1996 (the ‘A&C Act’). [MMTC Limited vs Aust Grain Exports Pty. Ltd., 2023 SCC Online Del 3612: (2023)3 HCC (Del) 32]. In this case analysis, the judicial principles behind the setting aside of an arbitral award under section 34 of the A&C Act have been briefly discussed.
