Scope of Judicial Interference with Arbitral Awards under Section 34 of A&C Act - Batliboi Case

On 21.09.2023, the Supreme Court of India (SCI) dismissed an appeal filed by the Batliboi Environmental Engineers Limited (Appellant) against the judgment given by the Division Bench of the High Court of Judicature at Bombay (HC). The main bone of contention was the scope of judicial interference with arbitral awards under s.34 of the Arbitration and Conciliation Act, 1996 (Act). [Refer Batliboi Environmental Engineers Limited v. Hindustan Petroleum Corporation Limited and Another, 2023 SCC OnLine SC 1208] In an appeal filed by the Hindustan Petroleum Corporation Limited (Respondent) under s.37 ofthe Act, the HC, exercising its power and jurisdiction unders. 37 read with s.34 of the Act, set aside the arbitral award.
