Whenever a writ petition isinstituted before High Courts the question with respect to maintainability of the writ on the grounds of locus standi, jurisdiction, presence (or lack thereof) of any effective alternate remedy, prima facie existence of violation of fundamental rights of the Petitioner etc. are to be ascertained at the initial stage before it is adjudicated on merits.
