The Supreme Court in Garg Builders vs. Bharat Heavy Electricals Limited 2021 SCC OnLine SC 855, has dealt with the question as to whether interest pendente lite (i.e. interest pending adjudication of disputes) can be granted on the amount of an Award when the agreement contains terms barring payment of interest. The powers of Arbitrator within the scope of Section 31(7)(a) of the Arbitration and Conciliation Act, 1996 (the said Act) was also discussed in detailed by the Hon’ble Court.
