Cyber Law - Issue 13 - X Corp. (Twitter) vs. Union of India

Twitter, the Petitioner, filed a writ petition before the High Court of Karnataka at Bengaluru challenging certain Blocking Orders (“BO”) issued by the Ministry of Electronics & Information Technology, Government of India, the Respondent, whereby it was directed to bar access to certain information to the public available on the online platform of the Petitioner. The Petitioner claims that BO against 1474 Twitter accounts and 175 tweets are arbitrary and non-compliant with the procedural and substantive requirement under section 69A of the Information Technology Act, 2000 (“IT Act”), lacking transparency, absence of prior notices to the originators of the objectionable content, violates fundamental rights under the Constitution of India and Principle of Natural Justice.
