The Supreme Court recently, in the case of Gujarat State Disaster Management Authority v. Aska Equipment Limited (for short ‘Aska Equipment Case’) [2021 SCC Online SC 917], observed that the requirement under Section 19 of the Micro, Small and Medium Enterprises Development Act (for short MSME Act) of pre-depositing 75% of the awarded amount while preferring the application/appeal for setting aside the award, is mandatory.
