Cyber Law: Series 2: Issue 12 - Right to Digital Access is a Part of Article 21 of the Constitution Pragya Prasun & Ors vs. UOI & Ors and Amar Jain vs. Union of India & Ors.

In the present case, two writ petitions, W.P.(C) No. 289 of 2024 and W.P.(C) No. 49 of 2025, involving common, interlinked, and similar issues, were heard together by the Hon’ble Supreme Court of India (SCI).

The petitioners in W.P.(C) No. 289 of 2024 are acid attack survivors with facial disfigurement and severe eye burns unable to complete visual-based Know Your Customer (KYC) tasks blinking or facial recognition The petitioner in W.P.(C) No. 49 of 2025 is a person suffering from 100% blindness who faced barriers in digital KYC processes requiring visual interactions (e.g. blinking, reading, displayed text).
